1. Scope and Acceptance
These Terms of Service (“Terms”) constitute a legally binding agreement between You (“User”) and PaD-HiT, operated by CAF-holding (EI).
By installing, accessing, or using the PaD-HiT mobile application (the “Application”), You acknowledge that You have read, understood, and accepted these Terms without reservation.
If You do not agree with these Terms, You must immediately stop using and uninstall the Application.
2. Relationship with Terms of Sale
Where the Application is purchased through an authorized third-party platform acting as Merchant of Record (including Payhip), the sale of the Application, pricing, payment conditions, refunds, and applicable consumer rights are governed by separate Terms of Sale.
In case of conflict, the Terms of Sale shall prevail with respect to commercial, payment, tax, and refund-related matters.
3. Purpose of the Application
PaD-HiT is an audio cue and instant sound-trigger application designed for live performances, rehearsals, teaching, and time-sensitive stage environments.
The Application is not a music production platform, streaming service, or social network and does not provide public sharing or hosting of content.
4. License to Use
Subject to full payment of the applicable price, PaD-HiT grants You a limited, non-exclusive, non-transferable, revocable license to install and use the Application strictly in accordance with these Terms.
This license does not grant ownership of the Application or any of its components.
5. User Audio Content
You may use audio files that You legally own or are authorized to use. All audio content remains stored locally on Your device.
PaD-HiT does not host, upload, distribute, or claim ownership over User audio files.
6. Prohibited Uses
- Any unlawful use of the Application;
- Use of audio content without proper rights;
- Reverse engineering or modification of the Application;
- Bypassing security or technical limitations.
7. Intellectual Property
All intellectual property rights related to the Application, including software, design, branding, and source code, remain the exclusive property of PaD-HiT.
8. Disclaimer of Warranties
The Application is provided “as is” and “as available”, without warranties of any kind, including performance, accuracy, synchronization, or uninterrupted availability.
9. Limitation of Liability
To the fullest extent permitted by law, PaD-HiT shall not be liable for any damage, loss, or disruption arising from the use or inability to use the Application, including in live or time-sensitive contexts.
The User acknowledges that the Application is a support tool and must be tested prior to any live or professional use.
10. Termination
You may terminate this Agreement at any time by uninstalling the Application. PaD-HiT may suspend or terminate access in case of breach.
11. Refunds and Withdrawal Rights
The Application constitutes digital content delivered immediately upon download.
In accordance with Article 16(m) of Directive 2011/83/EU, the User expressly acknowledges that the right of withdrawal is waived once access to the digital content has begun, provided that express consent has been given prior to purchase.
12. Governing Law
These Terms are governed by French law. Mandatory consumer protection laws applicable in the User’s country of residence remain unaffected.
